Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of Credible Captain (the “Platform”), operated by Credible Captain LLC, a California limited liability company (“Credible Captain,” “we,” “us,” or “our”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

    Eligibility and Age Requirements

    The Platform is intended for general audiences and allows the submission of user reviews.

    • Children under the age of 13 are not permitted to create accounts or submit content.

    • Users aged 13 to 17 may submit reviews or content based on genuine personal experiences, but may not create business accounts or use business-related features.

    • You must be 18 years of age or older to:

      • Claim or manage a business profile

      • Enter into any agreement with Credible Captain

      • Purchase or use paid or business-related features

      • Act on behalf of a business

    By using features that require legal capacity, you represent that you are legally authorized to do so.

    Children’s Privacy (COPPA Compliance)

    Credible Captain does not knowingly collect personal information from children under 13, in compliance with the Children’s Online Privacy Protection Act (COPPA).

    If we become aware that personal information from a child under 13 has been collected without verified parental consent, we will promptly delete such information.

    Parents or legal guardians who believe their child has submitted personal information may contact support@crediblecaptain.com.

    Platform Role and Neutrality

    Credible Captain is an independent and neutral review platform.

    We:

    • Host user-generated reviews and business responses

    • Display credibility indicators based on internal methodologies

    • Do not endorse, recommend, certify, or guarantee businesses

    • Do not verify the factual accuracy of individual reviews

    Reviews reflect individual opinions and experiences, not statements of verified fact.

    No Pay-to-Influence Policy

    Credible Captain does not sell:

    • Review placement

    • Review removal

    • Review suppression

    • Rating manipulation

    Any business tools, subscriptions, or features (if offered) do not affect review visibility, ratings, credibility indicators, or moderation outcomes.

    User Accounts

    Certain features may require account creation.

    You agree to:

    • Provide accurate and current information

    • Maintain account security

    • Be responsible for activity under your account

    We may suspend or terminate accounts that violate these Terms.

    Reviews and User-Generated Content

     6.1 Ownership and License

    You retain ownership of content you submit (“User Content”). By submitting content, you grant Credible Captain a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute it in connection with the Platform.

     6.2 Review Standards

    Reviews must be based on genuine first-hand experiences.

    You may not submit content that:

    • Is false, misleading, or unlawful

    • Is defamatory or harassing

    • Contains hate speech or threats

    • Is promotional, incentivized, or coordinated

    • Is submitted in exchange for compensation or pressure

    Credible Captain may remove or restrict content that violates these standards.

     Business Profiles and Claiming

     7.1 Business Listings

    Business profiles may be created automatically using publicly available information or user activity. Credible Captain does not verify ownership unless a profile is claimed.

     7.2 Claiming a Business

    Claiming a profile requires identity and authority verification.

    Claimed businesses may:

    • Respond publicly to reviews

    • Submit dispute requests

    • Update business information

    Claiming a profile does not grant ownership or control over reviews.

    Review Disputes and Moderation Workflow

    8.1 Dispute Requests

    Businesses may dispute reviews that allegedly:

    • Are not based on genuine experiences

    • Are defamatory or unlawful

    • Are promotional, incentivized, or fraudulent

    • Violate these Terms

    8.2 Review Process

    Credible Captain may:

    • Request additional information

    • Apply credibility labels or indicators

    • Maintain, restrict, label, or remove content

    Credible Captain does not adjudicate factual truth, legal liability, or business performance.

    8.3 Final Decisions

    All moderation decisions are final unless otherwise required by law.

    Credibility Indicators and Scores

    Any scores, labels, or indicators displayed:

    • Are informational only

    • Are based on internal methodologies

    • Are not guarantees, certifications, or factual findings

    Prohibited Conduct

    You may not:

    • Manipulate reviews or ratings

    • Submit mass, coordinated, or automated content

    • Harass users or businesses

    • Reverse-engineer platform systems

    • Interfere with platform security

    Intellectual Property

    All Platform content (excluding User Content), including trademarks, branding, software, and designs, are owned by Credible Captain LLC and protected by law.

    Disclaimer of Warranties

    The Platform is provided “as is” and “as available.

    To the fullest extent permitted by California law, we disclaim all warranties, including accuracy, reliability, and uninterrupted availability.

    Limitation of Liability

    To the maximum extent permitted by law, Credible Captain shall not be liable for indirect, incidental, consequential, or punitive damages.

    Total liability shall not exceed $100 USD or the amount paid to Credible Captain in the prior 12 months, whichever is greater.

    Indemnification

    You agree to indemnify and hold harmless Credible Captain LLC from claims arising from:

    • Your content

    • Your use of the Platform

    • Your violation of these Terms

    Arbitration and Class Action Waiver

    Any dispute shall be resolved by binding arbitration under the Federal Arbitration Act.

    • Arbitration venue: California

    • Claims must be brought individually

    • No class or representative actions

    You may opt out within 30 days of first use by emailing support@crediblecaptain.com.

    Governing Law and Venue

    These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

    If arbitration is unenforceable, disputes shall be resolved exclusively in California courts.

    Privacy

    Use of the Platform is governed by our Privacy Policy, compliant with CCPA and CPRA.

  • 18

    Termination

    We may suspend or terminate access at any time for violations or lawful reasons.
